    <title><![CDATA[High Street TV Complaint Upheld]]></title>

    <description><![CDATA[<img src="http://www.shoppingtelly.com/images/news/high_street_tv.png" style="margin-left: 5px; margin-right: 5px; float: right;" width="275" height="98" />A complaint made to the Advertising Standards Authority (ASA) regarding High Street TV that broadcasts on Sky Channel 648 has been upheld.<br /><br />A voice-over on an infomercial, on High Street TV Ltd, stated "Some store-bought juices may sit on the shelf for days, packed with added sugar, preservatives and salt. Juice is usually at its best when freshly squeezed. When you make juice at home with the Power Juicer Express you know exactly what's going into your juicer and into your body".<br /><br />The complainant, who understood that products described as a fruit "juice" in the UK could not contain added sugar, preservatives or salt and had to be made from 100% fruit juice, challenged whether the claim "Some store-bought juices may sit on the shelf for days, packed with added sugar, preservatives and salt" was misleading.<br /><br />High Street TV Ltd (High Street TV) said, according to the "Fruit Juice and Fruit Nectars Regulations", the name of a fruit, followed by the word "juice" could only legally be used to describe a product that was 100% fruit juice. They said the ad referred to store bought juices and not store bought fruit juices. They said store-bought juices could incorporate any juice drinks that were not defined in the regulations and could be used to describe any drink which included any amount of juice, however little. They said many of these juice drinks also included flavourings, artificial sweeteners and colourings and referred to an article from the British Soft Drinks Association which stated "Still and juice drinks are simply soft drinks made with varying quantities of different types of fruit juice. Therefore the blend of fruit juice with other ingredients such as sweeteners and preservatives means that they are covered by different regulations from pure fruit juices". They said the ad did not refer to all juices found in store and the claim that "Some store bought juices may sit on the shelf ..." made clear that they were not referring to a particular type of juice.<br /><br />The ASA noted that The Fruit Juices and Fruit Nectars (England) Regulations stated that products described as "fruit juice" could not contain added sugar and lemon juice, sugars or acidifying agents, as permitted by the European Parliament and Council Directive on food additives other than colours and sweeteners, and had to have a minimum juice and/or puree content of between 25% and 50%, depending on the fruit. Whilst we acknowledged that the voice-over referred to store-bought juices, and not to fruit juices, we noted the infomercial promoted a juicer that was used to juice whole fresh fruits and vegetables and showed the presenter demonstrating this. We considered that the average viewer would not necessarily be aware of the differences between "fruit juice" and "juice" and that, in the context of the demonstration, they would understand that the claim "Some store-bought juices may sit on the shelf for days, packed with added sugar, preservatives and salt. Juice is usually at its best when freshly squeezed ..." compared the juice produced by the product at home, with fresh fruit or vegetable juice sold in stores. Because the claim was based on juice drinks that included any amount of juice, and may have included flavourings, artificial sweeteners and colourings, and not fresh fruit or vegetable juice, we considered the elements of comparison were not based on products that were sufficiently similar in nature and therefore concluded that the claim was misleading.<br /><br />The ad breached BCAP Code rules 3.1 (Misleading advertising) and 3.38 (Other comparisons).<br /><br />The ad must not appear again in its current form. The ASA  told High Street TV Ltd to ensure comparisons were clear and fair in future.<hr>]]></description>
